1. INTRODUCTION

This Privacy Policy explains how Sept-Marianne ("Platform"), operated by Saad Aboussabr ("Owner", "We", "Us"), collects, uses, and protects personal data. We are committed to compliance with Moroccan Law 09-08 relating to the protection of individuals with regard to the processing of personal data.

By using the Platform, you agree to the collection and use of information in accordance with this policy.

2. STATUS AND DEFINITIONS

To ensure compliance with data protection laws, we distinguish between two types of data roles:

  1. Our Role as Data Controller: We act as a Data Controller only regarding the account information of our direct Users (the individuals or entities who sign up for Sept-Marianne).
  2. Our Role as Data Processor: Where Users utilize the Platform to create forms, quizzes, or workflows to collect data from third parties ("Respondents"), the User is the Data Controller and the Owner is exclusively a Data Processor. The User is solely responsible for the legal basis of such collection.

3. DATA WE COLLECT (AS CONTROLLER)

We collect the following personal data necessary for the operation of the Service:

  • Identity Data: Names, usernames.
  • Contact Data: Email addresses, phone numbers.
  • Technical Data: IP addresses, browser type, device information, operating system.
  • Usage Data: Information on how you use the Platform, log data, and interaction history.
  • Uploaded Files: Documents or assets you upload for your own use.
  • Financial Data: Payment processing is handled by third-party secure providers; we do not store full credit card details.

4. DATA WE DO NOT INTENTIONALLY COLLECT

We strictly limit our data collection. As the Platform Owner, we DO NOT intentionally solicit, store, or process identifying data in the following categories for our own purposes:

  • Biometric Data (fingerprints, facial recognition).
  • Official Identity Documents (CIN, Passport scans), unless legally mandated for KYC.
  • Health Data or extensive medical records.
  • Religious or Political beliefs.

Warning to Users: If you, as a User, choose to collect such sensitive data through your created forms, YOU ASSUME FULL LEGAL RESPONSIBILITY for compliance with Law 09-08 and applicable international regulations (e.g., GDPR Article 9).

5. USE OF DATA

We use your data strictly to:

  • Provide and maintain the Service.
  • Manage your Account and subscription.
  • Communicate with you regarding updates, security, or support.
  • Monitor usage to prevent abuse and ensure security.
  • Comply with legal obligations under Moroccan law.

WE DO NOT SELL YOUR PERSONAL DATA. Data is not traded, sold, or leased to third parties for marketing purposes.

6. DATA STORAGE AND TRANSFERS

  • Location: Data is stored on secure servers. While we prioritize security, cross-border data flows may occur depending on our hosting infrastructure providers.
  • Security: We implement standard security measures (SSL/TLS encryption, access controls). However, no method of transmission over the Internet is 100% secure.

7. THIRD-PARTY SERVICES

We may employ third-party companies and individuals to facilitate our Service ("Service Providers"), such as:

  • Analytics: Google Analytics (configured to anonymize traffic where possible).
  • Payments: Secure payment gateways (e.g., Stripe, PayPal, CMI).
  • Emailing: Transactional email services.

These third parties have access to your personal data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

8. YOUR RIGHTS (LAW 09-08)

  • Analytics: Google Analytics to understand platform performance.
  • No Advertising Cookies: We do not use third-party advertising cookies or tracking pixels for behavioral targeting.

10. CHILDREN'S PRIVACY

Our Service does not address anyone under the age of 18 ("Children") as a primary target. We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us.
